1. Acceptance of Terms

By downloading, installing, accessing, or using ButterflyLinker (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

ButterflyLinker is a network diagnostics & safety tool with an optional encrypted Tunnel. It provides:

• Wi‑Fi Risk Score with local analysis
• DNS Integrity & Leak Check
• Speed Curve with anomaly markers
• Optional Tunnel Connection

Diagnostics run locally and work without the Tunnel. The App is not for bypassing content restrictions.

4. User Responsibilities

4.1 Legitimate Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal activities
• Violate any local, state, national, or international laws or regulations
• Infringe upon the rights of others
• Transmit harmful, malicious, or illegal content
• Attempt to gain unauthorized access to any systems or networks
• Use the App to bypass security measures or access restricted content
• Resell or redistribute the App or its services

4.2 Device Security

• You are responsible for maintaining the security of your device
• You are responsible for all activities that occur under your device
• You must immediately notify us of any unauthorized use of your device

4.3 Server Configuration

• You are responsible for configuring Tunnel servers correctly
• You are responsible for ensuring that server configurations comply with applicable laws
• We are not responsible for the availability, security, or performance of third-party Tunnel servers

5. Tunnel Service

5.1 Service Availability

• The App provides Tunnel functionality, but we do not provide or maintain Tunnel servers
• You must configure your own Tunnel servers using VLESS configuration files
• We are not responsible for server availability, uptime, or performance
• Tunnel connections may be interrupted or unavailable at any time

5.2 No Guarantees

We make no guarantees regarding:

• Tunnel connection speed or performance
• Server availability or uptime
• Protection against all security threats
• Access to geo-restricted content
• Anonymity or privacy beyond what is technically provided by Tunnel encryption

5.4 Not a VPN Service Provider

We do not provide, operate, or maintain any Tunnel/VPN servers. The App is a diagnostics & safety client. You may configure your own servers where lawful. The App is not a content-unblocking service and must not be used to circumvent regional restrictions or platform policies.

5.3 Technical Limitations

• Tunnel services may be blocked or restricted in certain jurisdictions
• Some websites or services may detect and block Tunnel connections
• Tunnel connections may affect your internet speed
• Not all applications or services may work correctly through Tunnel connections

6. Intellectual Property

6.1 App Ownership

The App, including its design, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to:

• Download and install the App on your personal device
• Use the App for personal, non-commercial purposes

6.3 Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Create derivative works based on the App

7. Premium Subscriptions

7.1 Subscription Plans

We offer Premium subscriptions that provide an ad-free experience:

• Monthly subscription (auto-renewing)
• Quarterly subscription (3 months, auto-renewing)
• Yearly subscription (12 months, auto-renewing)

7.2 Payment and Billing

• All subscriptions are processed through Apple's App Store
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions through your Apple ID settings

7.3 Free Trial

If a free trial is offered:

• Any unused portion of a free trial period will be forfeited when you purchase a subscription
• The subscription will automatically start at the end of the trial period unless cancelled

7.4 Cancellation and Refunds

• You can cancel your subscription at any time through your Apple ID settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled by Apple according to their refund policy
• We do not provide refunds directly; please contact Apple Support for refund requests
• No refunds will be provided for partial subscription periods

8. Advertising

8.1 Ad Display

• Non-subscribed users will see advertisements displayed through Google AdMob
• Advertisements are displayed in accordance with Google's advertising policies
• We do not control the content of third-party advertisements

8.2 Ad-Free Experience

• Premium subscribers enjoy a completely ad-free experience
• Ads are removed immediately upon successful subscription purchase
• If you cancel your subscription, ads will resume at the end of your billing period

8.3 Third-Party Advertisers

• We use Google AdMob to display advertisements
• AdMob may collect data for ad serving and personalization
• We are not responsible for the privacy practices of advertisers

9. Third-Party Services

The App uses third-party services and libraries, including:

• Apple's StoreKit (for in-app purchases)
• Apple's Network Extension Framework (for Tunnel functionality)
• Google AdMob (for advertising)
• Open-source libraries (CryptoSwift, Alamofire, SnapKit, SVProgressHUD, GRDB)

Your use of third-party services is subject to their respective terms and conditions. We are not responsible for the availability, functionality, or content of third-party services.

10. Disclaimers

8.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF SERVICES

8.2 No Liability

WE SHALL NOT BE LIABLE FOR:

• Any damages resulting from your use of the App
• Loss of data or information
• Service interruptions or failures
• Security breaches or unauthorized access
• Any indirect, incidental, special, consequential, or punitive damages

8.3 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).

11. Indemnification

You agree to indemnify, defend, and hold harmless us, our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

12. Prohibited Uses

You may NOT use the App:

• For any illegal purpose or in violation of any laws
• To transmit spam, malware, or harmful code
• To infringe upon intellectual property rights
• To interfere with or disrupt the App or servers
• To impersonate any person or entity
• To collect or harvest information about other users
• For any commercial purpose without our written consent

13. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key Privacy Points:

• No account required — no email, no sign-up
• We do not store logs or track user activity
• Your connection data stays on your device
• We do not collect personal data

14. Termination

12.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Ceasing to use the App

12.2 Termination by Us

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Illegal or fraudulent activity
• Technical issues or security concerns
• Discontinuation of the App

12.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• All data stored locally on your device will remain until you uninstall the App
• We are not obligated to retain or provide any data

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date at the top of these Terms

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

• Good faith negotiations
• If negotiations fail, binding arbitration in accordance with the rules of the Kuala Lumpur Regional Centre for Arbitration (KLRCA)

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

20. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

21. Apple-Specific Terms

19.1 App Store Terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support or maintenance
• Apple is not responsible for any claims related to the App
• If the App fails to conform to any applicable warranty, you may notify Apple for a refund

19.2 iOS Requirements

• The App requires iOS 15.6 or later
• The App uses iOS Network Extension framework for Tunnel functionality
• You must comply with Apple's App Store Terms of Service
